RETURNS & REFUNDS - PLEASE NOTE: If the customer orders the wrong case - the customer is responsible for returning the case to us. Returns are accepted if received by us within 30 days of shipping to customer - a full refund (minus shipping charges) will be issued if the case is in 'As New' condition. Custom cases & Personalized cases are not returnable.
LIMITED WARRANTY
All products manufactured by The Peak Case Co. ("Peak Case"), are guaranteed by a Lifetime Warranty against defects in materials and workmanship from the date of purchase. Peak Case will replace or repair (at our discretion) without cost to our customers any item manufactured by Peak Case found to be defective as a result of defective material or workmanship that is still owned by the original purchaser. We will not, however, repair any item which is not properly installed, abused or subject to any use other than that which was originally intended. The warranty does not cover normal wear and tear of the product, which is expected over the course of ownership. Any repairs by the customer must receive specific written authorization from Peak Case before being executed to receive proper reimbursement for associated costs. In no event shall liability under this warranty exceed the original purchase price. TO THE EXTENT PERMITTED BY LAW: (A) THIS WARRANTY IS IN LIEU OF ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE; (B) ALL OTHER IMPLIED WARRANTIES AND ANY LIABILITY NOT BASED UPON CONTRACT ARE HEREBY DISCLAIMED AND EXCLUDED; AND (C) IN NO EVENT SHALL PEAK CASE BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR SPECIAL DAMAGES, REGARDLESS OF WHETHER A CLAIM FOR SUCH DAMAGES IS BASED ON WARRANTY, CONTRACT, NEGLIGENCE OR OTHERWISE .
Peak Case will either repair or replace any broken or defective product, at our sole option. TO THE EXTENT PERMITTED BY LAW, THIS SHALL BE THE SOLE AND EXCLUSIVE REMEDY OF THE PURCHASER.
To make a warranty claim, the purchaser must contact The Peak Case Co. by calling 1-435-319-6870. Any warranty claims shall be made by the purchaser as soon as practicable. The purchaser must obtain a return authorization number from Peak Case Customer Service prior to returning any product, and is responsible for paying for all warranty freight costs. If Peak Case determines that any returned product is not defective, within the terms of this warranty, the purchaser shall pay Peak Case all costs of handling & return freight.
All warranty claims of any nature are barred if the product has been altered, damaged or in any way physically changed, or subjected to abuse, misuse, negligence or accident.
